Mediation is a compulsory component of all family law proceedings and is being used more and more often by lawyers, prior to the issue of court proceedings, to try and resolve a dispute between parties before the parties become too entrenched in their respective positions. The focus is on open dialogue and co-operation to achieve a mutually beneficial outcome. It focusses parties on resolutions to their dispute which benefit both, leading to a result which both parties can consider fair.
The average cost of court proceedings in Australia exceeds $50,000 and a matter can take 2 years to progress through the court system. Mediation costs a fraction of that and is a fixed fee so you know exactly what you will be spending on the process. A further benefit of mediation is that, with proper preparation, it can be completed in a day.
My fees for mediation are negotiable and largely based on the size of the asset pool, with a maximum fee of $3,000 inc. GST. My fee includes a full day mediation and pre mediation conferences for all parties.
